reclamation, to the Eastward of Mr. Howard's premises, was commenced on 31st August, 1891, and the reclamation was practically completed by the 1st of January, 1896. This work, as I have indicated, was carried out without causing anything which, in my opinion, could be upheld to give Mr. Howard a valid claim to compensation. Mr. Howard, in a letter dated 30th March, 1892, to the Colonial Secretary, says, "I have to say that as the Reclamation has not yet interposed between our property and the sea, no depreciation has at present taken place, and it is therefore impossible to prove an unascertained loss." The underlining is Mr. Howard's. This was written 4 or 5 months after the pierre perdue had had its full effect upon the pier, and after the seaward end of the pier had been removed in consequence thereof. He repeats the above statement in his letter to the Colonial Secretary dated 1st July, 1892. I believe that everything that was done to the Eastern portion of the reclamation, after the first of the pierre perdue was deposited, was to Mr. Howard's advantage.

The work of depositing pierre perdue on the reclamation, immediately in front of Mr. Howard's premises, was commenced on 16th April, 1898, and it was brought up to its full height by the 31st of December of that year. I should fix the 1st of September, 1898, as the date when the works might reasonably be admitted to begin to cause some appreciable inconvenience to the Marine Lot Owners.
